Notice of Unconstitutionality of Bill 201 “Justice and Social Services” act

We received a concerned message from a member on Bill 201 “Justice and Social Services” act and the Constitutionality of the bill. As a result of the member’s concerns, we drafted a Notice of Unconstitutionality and sent it to all the MLAs, the House of Assembly and several media contacts. Below is the letter. Note: despite the grave Constitutional violations outlined in the letter below, the bill was passed tonight (April 08) by a vote of 39 for and 12 against. The level of ignorance in the majority of our de-facto government is shocking to many of us who think clearly; we can see that the spectacle that is the house of assembly, is just that: a spectacle where small thinkers get a soapbox. Bravo to the 12 who voted no.

Research Involving Human Subjects: Is Nova Scotia Ready?

For simplicity’s sake, let’s just say that in clinical research/clinical trials, you, as a participant, will receive the Cadillac of care: no wait times for imaging, diagnostic tests, prompt medical attention if you experience what is referred to as an Adverse Event (AE). This highlights the sad reality that in Nova Scotia with a deeply challenged health care system (shortage of medical personnel, equipment, IT infrastructure), your best bet to receive top-notch care, may be enrolling in a clinical trial.

Interestingly PHIA already has provisions – 31(l) and 38(1)(g) – which allow for the Minister to collect personal health information for the purpose of planning and management of the health system. It also already contains provisions for the Minister to collect that information for the purposes of creating or maintaining an electronic health record at 31(o). The difference now, however, seems to be that custodians will no longer be able to refuse to disclose your personal health information to the government.

To Moot Or Not To Moot

Mootness is the concept that some thing (incident or action) that was relevant at a given point in time is no longer relevant because that point in time for that issue/reason has passed. Most court cases against the pandemic lockdowns, restrictions and mandates across the country have been shut down due to Mootness.
