"The Judicial Review is still in play" The Honourable Justice Rosinski

 

This morning in Yarmouth Supreme Court Chambers, CANS put forth, and was granted, an adjournment to file an Amended Notice for Judicial Review filed on October 27th, 2021. The proposed amendment will add a youth applicant party as well as strengthen and clarify the current filing. The hearing was adjourned without a date pending the filing of the Motion for Amendment.

 

Important points asserted by counsel included:

1. The order of October 01st violates Charter sections

  • 7 Life, Liberty and Security of persons

  • 15 Equality

2. The order of October 01st is affecting tens of thousands of individuals and businesses

3. Repeated requests to the Crown on whether the protocol referred to in the October 01 order was law, policy or guideline which went unanswered.

 

Some technology anomalies that coincided directly with when CANS legal counsel was to speak were eventually resolved. CANS’ arguments were well-thought out and eloquently delivered by counsel.

 

Today's proceedings are considered to have concluded on a positive note and our next moves are all process & rule driven filings.
